This legal notice includes the general terms governing access to and use of the APPTONES instant messaging service (hereinafter " apptones service"), owned by APPTONES, S.L. and CIF: B86270642, registered in the Mercantile Registry of Madrid, Book 0, Volume 29087, Section 8, Page M 523696 Registration or annotation: 1 / Date 12/08/2011 and made available to users. Use of the service implies full acceptance of these terms, subject to specific conditions that may apply to certain and concrete services accessible on the web site or through the APPTONES applications.

To use our products and services through a mobile terminal (mobile phone) a record of the terminal should be made through an Internet connection with APPTONES.

Notwithstanding the foregoing, and in all cases, APPTONES reserves the right to activate the registration of each terminal only in the cases in which each user personally validates its terminal's phone number using the procedure set up by APPTONES.

Definition of Service

APPTONES is a useful application whereby the user logs in indicating their phone number. That phone number is sent to the AppTones server where it is stored together with a code that uses the terminal as reference. APPTONES will not keep other information of the user or device, not even the terminal's serial number or any other information that could identify you.

To install the application and use all the features, the user must agree to AppTones accessing the phone's contact list (by clicking on the appropriate place once an alert is displayed requesting authorization), after which a list of phone numbers is sent to the server with the sole purpose of having the server confirm to the terminal and to the app the contacts that are registered with AppTones and with which messages can be exchanged through the service.

  • - AppTones messages are sent to any contact that has been registered and no other additional code is required other than your phone number. If the recipient's phone number is in the iPhone contacts and it has been registered, this will be enough to send messages.
  • - The messages are sent through an AppTones server and, as part of the transport, they are temporarily stored from the time they are sent by the sender until they are downloaded by the recipient.
  • - Alerts are also sent to the recipient through Apple's APPLE PUSH NOTIFICATION system (through Apple servers).

The intellectual property of all the elements that make up the service, the Web site and application, source codes, design, navigation structure, databases and the various elements contained therein corresponds to APPTONES, which has ownership of the exclusive exploitation rights to them in any way, especially through the reproduction, distribution, public communication and transformation rights.

APPTONES S.L. owns all the www.apptones.net contents that are not reserved on behalf of other natural or legal persons.

Under no circumstances does access to the Web site content involve waving of, transfer, assignment, total or partial licensing of said rights, nor does it confer any right of use, translations, adaptation, alteration, exploitation, reproduction, distribution or public communication of said contents, without the prior express authorization from APPTONES or its legal owners. No material from those presented in the APPTONES web site may be copied, reproduced, published, uploaded on computers, e-mailed, transmitted or distributed in any way, especially through publication on web sites or network environments, except with irrefutable authorization granted by APPTONES.

Amendments

In order to improve the performance of service, APPTONES reserves the right to make, at any time and without notice, amendments and updates to the information and contents, to the configuration and design of the app and of this legal notice, as well as any other special conditions.

Disclaimer

APPTONES does not guarantee the absence of interruptions or errors in access to the service, nor that it has no defects in its operation, nor does it assume any responsibility stemming from the contents or the information sent or received through it, nor does it guarantee the absence of virus or other elements in them that could cause alterations in the computer system (hardware and software), in the user's documents or files or in the terminal itself, excluding any responsibility for any damages of any kind caused to the user for this reason, who accesses the site under its sole and exclusive responsibility.
